Terms & Conditions Cam Boys XXX Gay Cam CommunityThe following Terms of Use (TOU) govern all Internet activities of CamBoysXXX (owned and operated by WebsGold Limited) hereinafter referred to as ` CamBoysXXX Cam Community´. These TOU are the sole valid terms and conditions for business. They define the legal relationship existing between CamBoysXXX Cam Community and its Customers. Any agreement deviating from the present TOU will be made on an individual contractual basis and in the written form. 1. Services from CamBoysXXX Cam CommunityCamBoysXXX Cam Community offers Customers the possibility of opening and holding a personal account through registration. This account is given a unique user name. The account enables participation in the range of communication services offered by CamBoysXXX Cam Community. The use of third-party accounts is not allowed. The Customer pledges to act in accordance with all applicable and currently valid legal provisions. In its Business Policies published on its internet site, CamBoysXXX Cam Community specifies which natural and/or legal persons are allowed to open an account. 2. Changes to FunctionalitiesThe circumstance that CamBoysXXX Cam Community operates internet-related services renders the on-going modification, adaptation and development of content and functionalities imperative. Thus CamBoysXXX Cam Community is entitled to change and replace the design, lay-out and range of its functionalities and to supplement them with new ones. Any changes or deletions may be effected without authorization on the part of Customers. Only the basic functionalities (profiles, communication channels) will be maintained on a permanent basis. 3. Types of AccountThe Customer may open an account free of charge with CamBoysXXX Cam Community (hereinafter referred to as `Free Account´). This Account may contain images and text as allowed by the currently applicable provisions. A Free Account may be cancelled at any time either by the Customer or by CamBoysXXX Cam Community by simple deletion of the profile. The holder of a Free Account has no right to demand the continuance of his Account. In the event that a Customer infringes these TOU or violates applicable law, CamBoysXXX Cam Community reserves the right to place a "virtual ban" on him. In such cases the Customer may not apply for re-registration without the explicit permission of CamBoysXXX Cam Community. CamBoysXXX Cam Community the following type of Free Account: a. Private AccountsCustomers opening a Private Account are called "Users". Unless explicit arrangement to the contrary has been made by CamBoysXXX Cam Community, the use of a Private User Profile is exclusively reserved for natural persons and for private, non-commercial purposes. Double registration without express authorization from CamBoysXXX Cam Community may result in the deletion of both the profiles and the User being permanently barred from CamBoysXXX Cam Community. The User pledges that under no circumstances will he pass on his personal access data to third parties or make them in any way accessible to the same. The User himself carries sole liability for any misuse that might occur with his profile data. In particular the User must never pass on his access data or make them available to persons under the age of majority ("minors") in violation of the Law. The User is solely liable for any such misuse. 4. Payment Servicea. CamBoysXXX Cam Arena AccountsUsers may join the CamBoysXXX Cam Arena by the payment of a fee for use. Hereinafter such accounts will be referred to as `Pay Accounts´. Unlike Free Accounts, Pay Accounts feature numerous add-on functionalities. CamBoysXXX Cam Community publishes the current version of the functionalities available for Pay Accounts on its Homepage, along with details of subscription fees for Pay Accounts. A Pay Account is bound to your Membership Account and may not be transferred to any other Membership Account. b. fees for particular servicesCamBoysXXX Cam Community reserves the right to charge non-recurrent fees for particular services. These services will be clearly designated as such and the Members is required to give his prior explicit consent to the payment of the same. In particular non-recurrent fees may be charged for the the purchase fo time in the Cam Arena. 5. Registration with CamBoysXXX Cam CommunityThe User logs on CamBoysXXX Cam Community via the dedicated Internet Portal. Access information requested at this juncture must be accurate and truthful. CamBoysXXX Cam Community reserves the right to verify all data entered during registration or a change in the Profile in order to ensure compliance with the rules and regulations of these TOU. In case of any violation of the TOU CamBoysXXX Cam Community may immediately delete the entire profile without giving any prior notice and without supplying reasons. CamBoysXXX Cam Community shall administer the Picture Functionality in accordance with applicable statutory provisions and official decrees and directives. Illegal pictures shall be immediately deleted by CamBoysXXX Cam Community. By uploading pictures, the User expressly agrees and acknowledges that he is entitled to the corresponding copyright and that he is authorized to make use of this visual material within the terms of his copyright. 6. Age VerificationCamBoysXXX Cam Community respects and acts in compliance with all applicable provisions of the Law. The current version of the law stipulates that certain pictures can only be made accessible to an audience of Users who have furnished proof of their age of majority. In this context CamBoysXXX Cam Community holds the right of decision in deciding vis-à-vis Users which visual material is suitable for adults-only viewing and which may be viewed by a general audience. CamBoysXXX Cam Community accepts all the age verification systems as listed on its Homepage. The adult age verification procedure is subject to all applicable and currently valid legal constraints. CamBoysXXX Cam Community may change the adult age verification procedure at any time in order to remain in compliance with legal and administrative parameters. 7. Duration of ContractThe User will decide on the appropriate duration of contract. The duration of a Free Account is unlimited. a. Termination by UserThe User may terminate his Account by deleting it. All user data will be thereby deleted. In the case of the deletion of a Pay Account, any subscription fees paid will thereby be automatically forfeited. If the User wishes to open a new Account, he must register anew. In compliance with statutory and official regulations, CamBoysXXX Cam Community will retain the requisite data beyond the period of expiration of contract. b. Termination by CamBoysXXX Cam CommunityCamBoysXXX Cam Community reserves the right to refuse to enter into a contract without supplying any reasons or to terminate an existing Free Account. The rejection or termination of an Account is without limit with respect to any new registration by the User. The specific User concerned is thus excluded from use of the Internet Portal until such times as CamBoysXXX Cam Community should grant him permission to re-register. The rejection or termination of an Account (both Free Accounts and Pay Accounts) will be effected by CamBoysXXX Cam Community when the execution a Contract would be unacceptable for CamBoysXXX Cam Community, in particular when the User has already been found in violation of the laws of copyright, competition, criminal procedure or any other legal and judicial regulations or where there are grounds for supposing that he might be guilty of the same. CamBoysXXX Cam Community reserves the right to delete the respective Account or all the Accounts of a Member, in particular for the following reasons:
8. Duration of Contract for Pay AccountsUpgraded Pay Accounts can be taken out either by subscription or for a specified fixed period. Periods of contract and associated prices are published by CamBoysXXX Cam Community a. Renew SubscriptionsA Subscription Contract will run until such times as one of the Parties terminates it. Notice of Termination of Contract is possible at any time without supplying any reasons up to the next settlement period. In case of doubt a settlement period will be deemed as one calendar month. Termination is effected by deleting the Account or by terminating the Payment System with the appropriate Payment Provider. Claims for reimbursement of any outstanding excess fees for the then current settlement period are invalid. If a profile is deleted by CamBoysXXX Cam Community due to the User not having accessed it for too long a period, the subscription shall also be terminated. The User shall be informed of this by email. b. Fixed Duration ContractsOn a once-only basis a Contract may also be taken out for a specified fixed period. On expiry of the specified period, the Contract will be automatically terminated. Special notice of termination is not required. If the User prematurely terminates the Contract, any credit he may have will be forfeited. In this case a new Contract may be entered into at any time. However, CamBoysXXX Cam Community reserves the right not to grant more than one private profile to one natural person at any one time. Credit from one Contract may not be transferred to another. When a new Account is opened, the full amount for that Account should be paid. The User can either pay the fee due through the PaymentProvider (third-party provider) or by direct debit to CamBoysXXX Cam Community. However, Pay Accounts will only be activated once substantial proof that the User is of the age of majority has been furnished. Payment should be made in advance of the beginning of the settlement period. 9. In this case terms and conditions of payment will be set by the PaymentProvider itself. Payment by Credit Card with no Third Party ProviderThe User may also pay the fee due to CamBoysXXX Cam Community with a credit card (without a third-party provider). 10. Copyright by CamBoysXXX Cam CommunityAll programmed content including graphics, texts, programmed codes and layout are copyright by CamBoysXXX Cam Community in so far as it is not material owned by Users. Visual material uploaded by Users and all other such copyright-protected material is not subject to the copyright of CamBoysXXX Cam Community. In particular CamBoysXXX Cam Community shall not appropriate such material. By uploading pictures, the User expressly agrees and acknowledges that he is the owner of the copyright of the particular picture and that he is fully authorized to use such material for the intended purposes. 11. User Participation in "Users help Users"CamBoysXXX Cam Community is a genuine Community. To the extent prescribed by law, Users shall be involved in all key business processes. Users can assist other Users by answering their enquiries and questions and they can also assist CamBoysXXX Cam Community in the execution of a variety of tasks ("Users help Users"). CamBoysXXX Cam Community alone shall decide which Users assist with what types of tasks. Even when a User has been allocated to a certain function, CamBoysXXX Cam Community may terminate all special rights immediately at any time and without supplying reasons. a. Picture ValidationCamBoysXXX Cam Community makes every effort to comply with and implement all statutory provisions relating to the Law. In this context the User is granted the right to indicate whether the photos in question are not pornographic, pornographic or illegal. CamBoysXXX Cam Community shall set the rules governing this procedure. The final decision about the nature of the uploaded picture will be made by CamBoysXXX Cam Community. Should illegal content be uploaded, CamBoysXXX Cam Community, acting within the limits prescribed by law, shall report the offence immediately and deliver all relevant data to the public prosecutor’s office. 12. Data ProtectionTo use the range of services offered by CamBoysXXX Cam Community, the input of personal information is required. By opening an Account, the User irrevocably acknowledges and accepts that such personal information shall be stored. CamBoysXXX Cam Community undertakes not to pass on such information to private third parties. Only in cases where CamBoysXXX Cam Community is required to disclose personal information to the police, federal prosecutor or courts, will CamBoysXXX Cam Community pass on the same in compliance with its legal obligations. In particular, the collection and storage of User Account data by third parties for commercial purposes is explicitly prohibited. However, CamBoysXXX Cam Community will evaluate and process stored data in an anonymous form. No stored data or data evaluations may be passed on to any private third parties (in particular other users) without the prior explicit consent of the User(s) concerned. 13. SpamIt is expressly forbidden for all Users of CamBoysXXX Cam Community to send unsolicited mass mailings (Spam). The accounts of Users violating this provision shall be immediately deleted. CamBoysXXX Cam Community may ban such Users from all other Portals in its jurisdiction. Individual text messages are allowed at all times. Sending of Spam-type messages is only permissible with the prior explicit consent of each recipient involved. Such declarations of consent on the part of the User shall be made in electronic form within the CamBoysXXX Cam Community Platform. 14. AdvertsCamBoysXXX Cam Community offers the opportunity of publishing "small ads" under various categories and headings. The User alone is solely responsible for such content. Should any small ads violate these Terms and Conditions or any statutory provisions, CamBoysXXX Cam Community reserves the right to delete the advertisement and, in cases of serious violation, to delete the profile and report the violation to the appropriate authorities. The advert must be placed in one of the categories provided by CamBoysXXX Cam Community. These categories are restricted to certain types of Account. False and incorrect entries may result in the deletion of the advert and of the advertiser´s Account at any time and without prior notification. 15. LiabilityAlthough every effort has been made to prepare this Website with the greatest possible care, no liability can be accepted for the accuracy, technical availability or exactness of any content contained thereon. No liability for any damages arising from the direct or indirect use of this Website shall be accepted. In particular, CamBoysXXX Cam Community shall accept no liability for the correctness of any information supplied by its Users or Customers. CamBoysXXX Cam Community explicitly states that any content or activity on the part of its Users does not reflect the opinion of CamBoysXXX Cam Community itself. The rule governing the insertion of links by CamBoysXXX Cam Community or its Users is that: CamBoysXXX Cam Community has no influence whatsoever over the design or content of the sites so linked. Thus CamBoysXXX Cam Community explicitly distances itself from all content contained on the same. 16. Changes to the Terms and ConditionsCamBoysXXX Cam Community may change these Terms and Conditions at any time. Users will be notified of any changes over the respective Internet Portal. The current valid version of the Terms and Conditions may be downloaded from the Internet by Users. Individual notification of Users is not required. The User gives his consent to any changes in the TOU if he does not lodge objections to the same within the period of grace specified with publication. 17. Final ProvisionsPlace of jurisdiction is Amsterdam. Contracts are governed by the laws of the Netherlands. These Terms of Use exist in a Dutch, German and English version. In cases of dispute, the English version shall have precedence. Should any single provision of these Terms and Conditions be ineffective or prove to be ineffective, this shall be without prejudice to the remaining provisions of the TOU. CamBoysXXX Cam Community reserves the right to commission third party service providers and their authorised agents with the performance of CamBoysXXX Cam Community services, either in whole or in part. 17. Governing Law and SeverabilityGoverning Law and Severability. This Agreement shall be construed and enforced in accordance with the laws of the State of Ohio. Each of the provisions of this Agreement shall apply to full extent permitted by law, and the invalidity in whole or in party of any provision shall not affect the remainder of such provisions or any other provisions. 18.
